Gbaramatu lawyers laud INEC ward delineation report in Warri Federal Constituency, warns ltsekiri nation not to dare Gbaramatu kingdom with threat of war

Warri _____ The Gbaramatu Lawyers Association has called on the Independent National Electoral Commission  (INEC) not to be worried with the pockets of protests by Itsekiri Ethnic nationality, saying that the INEC delineation exercise in the Warri federal constituency was fair, free as all the ethnic stakeholders participated following supreme court directive for fresh delineation.
In a press briefing on Monday in warri by the Gbaramatu lawyers Association signed by the President, Friday Emotimide Esq, and Werisinde Timiyan, Secretary urged INEC to keep their published fair report on Warri Federal Constituency wards delineation of the three ethnic nationalities of Ijaw, Itsekiri and Urhobo.                       
 
The recent developments and subsequent negative reactions surrounding the fresh delineation exercise conducted by the Independent National Electoral Commission (INEC) in the Warri Federal Constituency in line with the decision of the Supreme Court of Nigeria have made it expedient that we take a position on the said matter.

According to the Ijaw lawyers forum,     Chronology of Events Leading to the Supreme Court Decision in Suit No: SC/413/2016: HON. GEORGE U. TIMINIMI & 9 ORS v. INEC.

  '' In 2011, having noticed the overwhelming fictitious units and ward structures in the Warri Federal Constituency of Delta State, which were being used to rig, manipulate and to subvert the will of the people of Warri Federal Constituency during elections, the Appellants in Suit No: SC/413/2016: HON. GEORGE U. TIMINIMI & 9 ORS v. INEC approached the Federal High Court and filed a suit against INEC, seeking an order of the Honourable Court to, amongst other things, order a “fresh delineation of all that units and wards in the Warri Federal Constituency for the purpose of future elections.” 

''The Federal High Court dismissed the suit and termed same as an academic exercise. 

    ''Dissatisfied with the said decision of the Federal High Court, the Appellants in line with their constitutionally guaranteed rights and with a dogged resolve to emancipate the entire constituency from the grave injustice of electoral manipulations, proceeded to the Court of Appeal, Benin Division. However, despite making very strong and cogent legal arguments, the Court of Appeal upheld the judgment of the lower Court and once again decided against the Appellants'' said.

    Continuing ''Further dissatisfied with the decision of the Court of Appeal, the Appellants approached the Supreme Court for final redress in the said matter, hoping against hope and defying all odds. Fortunately, the Supreme Court, in a well-considered decision, with the lead judgment delivered by the Hon. Justice Uwani Musa Abba Aji, JSC, on the 2nd of December, 2022 agreed with the arguments of the Appellants and ordered INEC to carry out “a fresh delineation of all that units and wards in the Warri Federal Constituency for the purposes of future elections.

''With one simple but strong and eternal blow, the Supreme Court, being the apex court in Nigeria, dismantled all the fictitious and baseless units and ward structures within the Warri Federal Constituency and paved the way for the correction of all electoral injustice, sharp practices and manipulations, which our people have suffered for decades.

Attempts at Frustrating the Supreme Court Order

The Association notes with utmost dismay the number of suits filed in lower courts by the Itsekiris all in a bid to frustrate the enforcement of the Supreme Court order. A suit was filed at the Federal High Court seeking to prevent INEC from proceeding with the delineation exercise. The said suit lingered for months with their counsels changed several times but at the end the Court dismissed the said suit for being a complete waste of time.

'' Again, in another calculated attempt to shut INEC from further implementing the judgment and releasing the result of the delineation exercise, they approached the Federal High Court, Abuja. Sadly, after several arguments and adjournments, the Federal High Court dismissed the said suit and this paved the way for INEC to release the said delineation report.

Time will fail the Association to mention several press releases, statements, and interviews on national television and online platforms sponsored by the Itsekiris to prevent the enforcement of the said judgment. Till date, all kinds of frivolous suits are still being filed and pursued all in a bid to ensure that the order of the Supreme Court does not come to light. The latest being a suit filed at the Federal High Court Warri questioning the membership of the panel that conducted the delineation exercise on grounds of ethnicity. 

We know as a matter of fact that if any of the justices that presided over the case that ordered the fresh delineation of the units and wards in the Warri Federal Constituency was an Ijaw or Urhobo, they would have heavily termed the panel as corrupt and biased. All these are attempts to frustrate the implementation of the judgment. However, we are not deterred. We take solace in the evergreen latin maxim that says “fiat justitia ruat caelum” ...let justice be done though the heavens fall...”

We also reiterate the position of law as emphasised in KANAWA & ANOR v INEC & ORS. (2020) LPELR-52117(CA), where the court made the point that “it is not controverted, that Courts do not exist for the purpose of interpreting the decisions of other Courts. Once a decision is given and that decision is tested at the Supreme Court, the matter ends there.”

Inflammatory and Inciting Statements
Since the release of the delineation report by INEC, there have been several comments and videos on social media platforms even from prominent leaders of the Itsekiri nationality inciting Itsekiri communities to take up arms against the Gbaramatu people. We would like to remind all the dramatis personae in the said scheme of incitement that they and their followers shall and will be criminally liable in the event that any member of the communities in Gbaramatu is attacked or maimed as result of their remarks. We also use this opportunity to call on all security agencies (NSA, DSS, the Nigerian Police Force, the Nigerian Army, Navy etc.) to invite, investigate and prosecute anybody or group persons who have made such inciting remarks in order to prevent a total breakdown of law and order in the Warri Federal Constituency.

Our Advice to INEC

Whilst we are pleased that INEC has finally taken steps to adhere to the decision of the Supreme Court, we however note that it took close to three years before the electoral umpire could adhere to the decision of the apex court. More concerning is the fact that INEC did not adhere to the decision of the Supreme Court in Suit No: SC/413/2016: HON. GEORGE U. TIMINIMI & 9 ORS v. INEC before conducting the 2023 General Elections in the Warri Federal Constituency.
In any event, we advise INEC to uphold the integrity of the Findings and Report that emanated from their field work. We urge INEC not to be deterred as they are statutorily bound to adhere to the decision of the Supreme Court and carry out their statutory duty as ordered by the Supreme Court, without more. We warn that any attempt to reverse their Findings and Reports which emanated from their field work would amount to an infraction of an already settled judicial process'' the noted.

He emphasized that the main vision of the event is to enable people moving in good health so as to prevent Obesity.
He noted there will be different activities on that day including strong man/woman challenge, football, table tennis, long tennis, snooker game, Ludo game, scrabble and also Safari Pharmacy would be there to provide free blood pressure and sugar level check up etc.

The organizers further assured participants of adequate security and serene environment, adding that the K/Q Restaurant will provide various Africa delicacies menu for affordable prices for participants. 

There will be free transportation to and fro positioned at various locations at PTI junction, DSC Permanent Camp and College of Education Edjeba to convey participants by 7AM, the statement added.

The Executive Chairman, Bomadi Local Government  Council, Hon Dagidi Rawlings Andaye on Monday sworn-in Mr. Boubai Tony Enai as the new Secretary, Bomadi Local Government at the council's auditorium.
The Secretary to the Local Government Council is a vital position, serving as the Chief Scribe of the Local Government Council, Secretary of the Executive Committee, and the coordination of the various departments in the council.
Andaye, speaking during  the inauguration, charged Mr. Enai to draw sterling qualities of late Famous Ofurobiri, his predecessor and urge him to demonstrate high responsibility, honesty, unity and dignity even in the face of challenges.

Just-ln: Tantita Security Services Donates Modern Police Divisional Headquarters with Two Operational Hilux for Ugborikoko in Delta State

It was all celebrations and excitement as the good people of Ugborikoko community in Uvwie LGA witnessed the commissioning of the newly built Ugborikoko Modern Police Station. The building which was built and furnished by Tantita security service Nigeria LTD contains state of the art facilities which includes a constructed quarter guard post, a dedicated generator house, drainage construction to ensure a healthy and safe environment, and reconstruction of the police hall giving it a modern and functional design. The commissioned project also includes two hilux vehicles for operational mobility, 30KVA soundproof generator and a 30KVA solar system to ensure uninterrupted power supply, CCTV cameras and computer systems to enhance surveillance and digital operations, television sets, air-conditioning units, fully equipped conference room and interrogation room.
The MD Tantita security services Nigeria LTD High Chief Kestin E. Pondi in his remark stated that as a private security with local roots and global reach, Tantita Security service Nigeria LTD understands that no society can thrive without peace and security. He also noted that peace and security is a result of collaboration between the community and the government and the first line of defense of preserving peace in Nigeria is the Nigeria Police Force, therefore the decision to build the Police station is a mark of Tantita’s commitment to rebuild the peace in Warri and improve the security of lives and properties for all residence in warri, effurun and environs.

PRESS BRIEFING BY THE OGBE-IJOH PEOPLE ON THE PROPOSED FRESH DELINEATION OF ELECTORAL WARDS/POLLING UNITS IN WARRI SOUTH LOCAL GOVERNMENT AREA OF DELTA STATE BY THE INDEPENDENT NATIONAL ELECTORAL COMMISSION (INEC) IN COMPLIANCE WITH THE SUPREME COURT JUDGMENT ON FRESH DELINEATION AND MATTERS THERETO

Since the Independent National Electoral Commission (INEC) on the 4th of April, 2025 released the report of its Fieldwork on the proposed delineation of electoral wards and polling units in the Warri Federal Constituency of Delta State, the Ogbe-Ijoh (Ijaw) people have noticed with keen interest series of protests by the Itseikiri and their allies in both print and electronic media including arguing that, the Ogbe-Ijoh (Ijaw) people are not part of Warri South Local Government. This press briefing is to clear this ignorance and set the records straight. 
It is important to note with specific reference to the Supreme Court ordered delineation that, the issue of whether the Ogbe-Ijoh (Ijaw) people are part of Warri South Local Government Area or not was raised at the INEC stakeholders meeting by the Itsekiris, reflected in the minutes of stakeholders meetings and it was dealt with by the stakeholders in the said meetings by resolving that from available intelligence reports, legal documents, physical communities on ground and existing electoral polling units, the Ogbe-Ijoh (Ijaw) people are integral part of Warri South Local Government, but denied electoral representation by not having homogenous electoral wards of their own, but balkanised into different polling units in different wards in Warri South LGA. The Itsekiris too admitted this fact. 

It was on this basis that, at the stakeholders meeting of Ijaw, Itsekiri and Urhobo held on 8th of July, 2024 at Government House Annex, Warri preparatory to starting the Fieldwork in Warri South LGA, a team of INEC Field Officers were assigned to the Ijaw areas in Warri South LGA, just as INEC Field Officers were assigned to the Itsekiri and Urhobo areas. Furthermore, the INEC field officers assigned to the Ijaw areas were the only ones who covered the Ijaw areas covered by the proposed Ewein, Bulouama, Ogbe-Ijoh Warri Urban and part of GRA wards of Warri South LGA. The INEC field officers assigned to Itsekiri and Urhobo areas did not and could not have covered these areas because they are indigenous Ijaw communities, where the Ijaws resides to the knowledge of all persons and authorities.
These facts are known to the Itsekiri leaders and especially those who participated in the INEC fieldwork, but are not telling the public. 
For historical purposes and to educate younger Itsekiri people who do not know the founding history of Warri, Ogbe-Ijoh is recorded as the first settlement in the present Warri Urban along the Ogbe-Ijoh-Warri River (otherwise known as the Warri anchorage) in Warri South Local Government Area of Delta State. Indeed, the present Warri started from Ogbe-Ijoh. In 1955, when the first local administrative structure was established and electoral delineation done in Warri Urban, the Ogbe-Ijoh (Ijaw) people were included in the Warri Urban District Council together with a section of Urhobo and Itsekiri as defined by Western Region Laws of Nigeria No 177 of 1955. The said law created four autonomous electoral wards for the Ijaw people of Ogbe-Ijoh, which were– Alders town B3, Ogbe-Ijoh Ward C1, Ogbe-Ijoh Ward C2 and Government Area F1. This structure with elected Ogbe-Ijoh Councillors remained operational till sometime in 1976, when the Olusegun Obasanjo’s Military Government introduced local Government reforms giving birth to the present local Government structure. The defunct Warri Urban District Council is today known as the Warri South Local Government Council. 

It is important to note that, before the introduction of Local Government administration, there were Seven (7) District Councils in the Warri area, including the Warri Urban District Council, which was only the Warri main City. But the Ode-Itsekiri District Council which was not part of the Warri Urban District Council was included to make up the present Warri South LGA. 

The introduction of Local Government Administration and the subsequent delineation of electoral wards in the area concerned led to the balkanization of the hitherto homogenous Ijaw fours in Warri South LGA into mere polling units in different wards mainly as minorities. The electoral wards that, the Ogbe-Ijoh people were balkanized into before the Supreme Court Ordered delineation of electoral wards were Pessu, GRA, Bowen and Okere wards.
The Ogbe-Ijoh areas were balkanized into these electoral wards and thereby making them minorities and politically weak. Since the 1976 balkanization of our homogenous four electoral wards, we have always protested and made known to successive electoral bodies of the need to balance the lopsided electoral wards in Warri South Local Government without much success before a group of patriotic Ijaw men sought legal redress leading to the celebrated Supreme Court judgement in December 2nd, 2022. 

It is these Ijaw areas previously delineated in 1955 as Alder's town B2, Ogbe-Ijoh C1, Ogbe-Ijoh C2 and Government area F1, that the INEC Field Officers assigned to the Ijaw areas visited and delineated as Bulou-Ama Ward 02, Ewein Ward 07 and Ogbe-Ijoh Warri Urban Ward 12 and the part of Ogbe-Ijoh areas in the GRA Ward 08.

Hence, the delineation of electoral wards and polling units to cover the Ijaw areas in Warri Urban is not a new development, but has been in existence for decades even before those protesting were born. The recent exercise only seeks to correct an obvious injustice where the Ijaws in Warri South LGA are delineated into different polling units and denied representation in the Warri South LGA administration. 

We wish to state further that, contrary to the false impression been created by the Itsekiris, the Ijaw areas have always been separated from the Itsekiri areas in Warri Urban. It is for this reason that, the Chiefs Law of 1957, CAP 19, provides that, the authority of the Itsekiri monarch, the Olu of Warri excludes Ogbe-Ijoh Areas. The 1979 Bendel State Traditional Rulers and Chiefs Edict, B.S.L.N 44, described the Amaokosu of Ogbe-Ijoh as the prescribed authority of Ogbe-Ijoh lands and people in Warri metropolis. This meant that, all the lands of the Ijaw of Ogbe-Ijoh are excluded from claims by the Itsekiri people.
Furthermore, the Delta State Traditional Rulers, Chiefs and Council Law, Vol. 3, now cap T3 Laws of Delta State, 2006 recognizes four Clans in Warri Metropolis: Itsekiri Kingdom, where the Olu is the prescribed authority, Okere-Urhobo Kingdom where the Orosuen of Okere-Urhobo is the prescribed authority, Agbassa Kingdom where the Ovie of Agbarha is the prescribed authority and the Ogbe-Ijoh Kingdom where the Amaokosu of Ogbe-Ijoh is the prescribed authority of Ogbe-Ijoh Kingdom in Warri metropolis.
The purpose of the above laws is to the effect that, the Ogbe-Ijoh Kingdom and their lands in Warri metropolis in Warri South Local Government Area are excluded from the claim of the Itsekiri people. This position has been confirmed by the Court of Appeal in Appeal No CA/AS/441/2016 in a judgement delivered on the 5th of June, 2023.  

In conclusion, we commend the Independent National Electoral Commission (INEC) for being able to commence the delineation process despite series of litigation against the Commission by the Itseikiri. We also commend the Commission in Warri South Local Government for being fair to all the ethnic nationalities and stakeholders. However, the Ogbe-Ijoh people state that, their areas should have been delineated into atleast five homogenous electoral wards. If the Ogbe-Ijoh people had four electoral wards as far back as 1955, it is only fair for the number to be increased decades after. We therefore call for the creation of more electoral wards for Ijaws in Warri Urban and also urge the Independent National Electoral Commission to disregard frivolous protests against the delineation exercise in Warri South LGA by the Itsekiris.

We wish to call on the INEC for creation of additional wards and state Constituency for the Ijaws of Warri South. This is predicated on the ground that the Itsekiris and Urhobos already have their own State Constituencies in the Warri South.
